Terms of use
These Terms and Conditions (“Terms”) apply to your use of the Pedal mobile and web application (“Pedal”, the “App” or “Service”), which is operated by Out of Hours XYZ Ltd, a company incorporated and registered in England and Wales under company number 16087213 (“we”, “us” or “our”). By registering for, accessing or using the Service, you agree to be legally bound by these Terms. If you do not agree, do not use the Service.
1. Definitions
• “User”, “you”, “your” refers to any person who uses Pedal.
• “Pedal Pro” refers to our paid subscription plan offering additional features.
• “Content” means any data, information, materials, documents, or communications uploaded, created, or otherwise made available via the Service.
2. Eligibility
You must be at least 18 years old and legally entitled to work as a driving instructor (or in training) in the United Kingdom. You warrant that all information provided upon registration is accurate and kept up to date.
3. Account Registration & Security
You are responsible for maintaining the confidentiality of your account credentials and any activities that occur under your account. You agree to notify us immediately of any unauthorised access or use. We reserve the right to suspend or terminate any account that, in our reasonable opinion, breaches these Terms.
4. Service Description
Pedal provides driving instructors with tools to manage diaries, pupil progress, finances, and other instructional activities. We reserve the right to modify or discontinue any part of the Service at any time with or without notice.
5. Subscriptions, Payments & Cancellations
• Paid Plan (Pedal Pro): All and additional features are available via a recurring subscription.
• Billing: Payments are handled via Stripe and subject to Stripe’s own terms and conditions. By subscribing, you authorise us to charge your selected payment method.
• Renewals: Subscriptions auto-renew monthly or annually unless cancelled prior to the renewal date.
• Cancellations: You can cancel at any time via your account settings. No refunds will be given for partial billing periods unless required by law.
• Free Trials: If offered, trials convert into paid subscriptions unless cancelled before the trial ends.
6. Acceptable Use
You agree not to:
• Use the Service in any unlawful manner or for any unlawful purpose.
• Attempt to gain unauthorised access to any part of the system.
• Copy, modify, distribute or reverse engineer any part of the App or Service.
• Upload any material that is false, misleading, offensive, defamatory or infringing.
We reserve the right to remove any content or suspend access that breaches these Terms
7. Intellectual Property
All intellectual property rights in Pedal, including but not limited to software, branding, designs, databases, and documentation, are owned by Out of Hours XYZ Ltd. We grant you a limited, non-exclusive, non-transferable licence to use the Service solely for your own business purposes.
8. Data Protection & Privacy
We only collect and use personal data as outlined in our Privacy Policy. You are responsible for ensuring the legality of any data you upload to the Service.
9. Third-Party Services
Pedal may integrate with third-party tools (e.g. Stripe, analytics providers). We are not responsible for their content, functionality or data practices.
10. Disclaimers & Limitation of Liability
• The Service is provided “as is” and “as available” without warranty of any kind.
• We do not guarantee the accuracy, reliability, or availability of any content or features.
• To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential loss or damages (including loss of earnings, data, or goodwill).
• Our total liability to you in connection with the Service shall not exceed the total amount paid by you for the Service in the preceding 12 months.
11. Suspension & Termination
We may suspend or terminate your account:
• For breach of these Terms.
• If required by law or for security reasons.
• Upon reasonable suspicion of fraud or misuse.
You may terminate your account at any time by contacting support or via the app.
12. Changes to the Terms
We may update these Terms from time to time. If material changes are made, we will notify you via email or in-app. Continued use after such changes constitutes acceptance.
13. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of England and Wales. You agree that the courts of England and Wales shall have exclusive jurisdiction over any dispute arising from or in connection with these Terms.
